He is on scaffolding about one hundred feet in the air. It is standard safety practice to secure your toolbox on high scaffolding to avoid dropping anything on people below. Frank is about to do this when he is distracted by a question from a foreman and simply forgets. Sometime later he accidentally kicks the toolbox off the scaffold, and it falls on the head of Jacobs, killing him.
