1. Jordan agreed on June 22 to purchase an automobile for $32,000 from Betsy. Jordan agreed in writing to pay for the car by making twenty monthly payments directly to Betsy starting on July 1, the date of delivery. On July 1, Jordan refused to accept the car and told Betsy he would not accept it. He noted "the payments include all that interest you are adding to the purchase price and the amount of interest will result in my paying over 40% annual interest rate to you. The highest legal rate in this state is 32% so your entire contract is void." Betsy agrees the interest rate is usurious but insists "Jordan must still pay for the car. He can pay the amount calculated at the maximum 32% rate." Jordan says he is not liable. Please discuss the likely result.
2. Mark, age seventeen, is a boy who decided he would move to an apartment because he was "always arguing with my parents." Mark located an apartment and signed a written, one-year lease at a rent of $600 per month. Mark began paying rent on Oc. 1, 2010 and moved into the apartment. He lived there for four months and then decided to move to live with two friends. He only paid three months' rent, $1800, to the landlord Albert. Mark told Albert he was disaffirming the lease and moved out on Jan. 31, 2011. Mark now has disaffirmed the agreement and has demanded all of his money be returned. Albert in turn claims Mark "owes me $5400 for the unpaid rent and the remaining eight months on the lease. He promised to pay in writing; it's too bad that he was too stupid to realize the place was only worth $400 per month. He is a deadbeat and all he wants to do is live with those two clowns so he can celebrate his eighteenth birthday on March 12th."
