Thomas Lent is a new legal assistant with a law firm that specializes in personal injury cases. He is reviewing a request for documents in a case his supervising attorney is handling for the plaintiff. The request is for the plaintiff's medical records, and Thomas's supervising attorney instructs Thomas to obtain copies of all of the plaintiff's medical records. The plaintiff's medical records file is several inches thick because the plaintiff is an elderly person and has various medical problems; however, it also contains some limited records that cannot be reobtained. Thomas is instructed to "accidentally" place the limited records in another file that the defendant's attorney has not requested. If she wants these records, she will have to request them again if she notices they are missing, says the attorney. What should Thomas do? Can the attorney be disciplined for this kind of behavior?
