Many civil and criminal trials rely on eyewitness testimony. As memory and cognitive abilities research progresses, we have begun to see how damaging eyewitness testimony can be, even leading to innocent people going to prison for crimes they did not commit.

Maria goes to a bar one night and has several alcoholic drinks. While leaving the bar, she witnesses a man physically assaulting a woman. Maria is terrified and feels her heart racing until the police arrive on the scene. Sixteen months later, Maria is called to testify in court. She is confident in her memory of that night and decides to provide her testimony. Maria overhears another witness describing the man as bald. When she gives her testimony, she emphatically describes seeing a bald man attacking a woman outside the bar. However, Maria gets several facts - including the man's baldness and general appearance - incorrect in her retelling of the event. Additionally, she is unable to identify the perpetrator out of the lineup of suspects.
