How would you respond to the following statements?  Please reply in detail and atleast 75 words and no plagiarism.

1) Yes, I agree that Click-to-Accept agreements are more common nowadays. From personal experience, I don't think it is fair to hold consumers to its terms though. Most consumers don't read it and in some instances you can't move forward in a document unless you sign or click the box of acknowledgment. First off, I think the document is too long and should maybe be broken down into a smaller version. It can be intimidating when a consumer sees a long document and we don't read it but sign anyways to move forward.

An example of a case where the courts did not enforce the terms of the Click-to-Accept agreement is Williams v. America Online, Inc. The results were that the terms of the agreement and the method of acceptance were not reasonable. The Massachusetts Supreme Court found it was unfair to hold the plaintiffs responsible due the the mechanism AOL used to obtain the plaintiff's acceptance.

2) I will say the purchase of a vehicle is the most common were the UCC differs from common law. The acceptance of an offer with different terms, contract modification, promise to keep an offer open, statute of limitations and terms are all different between the two. For example, if you buy a car you have specific terms you have to follow, like the day a payment is made and the period you have to make that payment. The common law doesn't specify these terms in detail like the UCC.

4) I would say I float in the middle on whether there is too much or not enough regulation on businesses. I can fully agree with the example you provided because I recently was not hired due to the individual who was hired threatening to file an Equal Opportunity complaint (I was told this by one of the supervisors). It is a shame and I wish they could reevaluate the regulations and laws put on businesses so they can ease up on some of them and tighten down on others.

5) I enjoyed reading your post this week about how companies like eBay are doing a great job keeping our digital information safe. I have used eBay to buy and sell items and found the procedures and polices safe and fair from both sides of the digital transactions.
