Drummond, a customer in a bar, gets into a heated discussion with the bartender (Bob) over politics. Bob gets very angry and throws a glass of scotch at Drummond, splashing him in the face with the alcohol. The alcohol causes severe burning of Drummond's eyes. Bob then asks Bouncer Bill to eject Drummond from the bar. Bill grabs Drummond, dislocating Drummond's arm. Drummond sues Joe Jergins, the owner of the bar, for $100,000 for the damage to his eyes and his arm. Bob, the bartender, had worked for Jergins for only two weeks, during which time there were no complaints. Jergins did a background check of Bob before hiring him and found nothing to suggest he had violent tendencies. Is Jergins liable for the injuries claimed by Drummond?
