Plaintiff owns dog he bought himself. his neighbour, the defendant, occasionally comes over to play with his dog in his fenced in backyard, with permission from plaintiff. the dog is outside a lot ebcause it is a fenced in yard. while plaintiff was gone running errands, the defendant came to play with dog, without permission and she brought her friend with her. when leaving, she did not clsoe the gate properly and the dog ran away. plaintiff looked for her and put up missing posters. she has not been found. plaintiff wants compensation for the incdient including original price of dog, registration and insurance fees, vet costs, and emotional distress. this is a small claims matter. we want to say that although shes been allowed in the yard before, she always got permission from the plaintiff, except in this instance. she never failed to close the gate before yes but she also never brought a friend unannounced before. she was distracted, careless and reckless. the plaintiff also testified that the lock on the inside of the gate is tricky and has to be double checked to make sure it is locked. the defendant was shown how to close it but this time she was distracted by her friend. plaintiff is suffering emotional distress and paid alot of money for the dog. the dog was his best friend, not just his property. plaintiff thought he could trust the defendant but trust has been broke. i need closing submissions.
