Contract Law is the ability to have recourse if another party does not live up to his side of the bargain. If this assurance did not exist, people would be less willing to negotiate with each other, less willing to contract with each other, and as a society we would all be worse off because of it. Why do some contracts have to be in writing? Should you put in writing some contracts that are legally enforceable even if they are only oral?
