You will apply the knowledge to the Michelle Carter and Conrad Roy case.
1. Briefly summarize the case in roughly three to five sentences. Be sure to clearly identify the specific actus reus, mens rea, motive, and resulting harm in your summary. (Keep the following in mind: The actus reus is NOT the same thing as the charged offense. The mens rea is NOT the same thing as the motive.)
2. Summarize the actus reus criteria in own words. For each of these criteria, you must convincingly explain whether the defendant's actus reus in this case meets the criteria. Be sure to support your arguments with evidence from the readings, commentaries, and/or assignment video.
3. Summarize the four gradations of mens rea identified in Chapter 5 (purposeful, knowing, reckless, negligent) in own words. Explain which level of intent was present in this case (and why the mens rea most closely fits with that level as opposed to each of the other 3). Be sure to support your arguments with evidence from the readings, commentaries, and/or assignment video.
4. In your educated opinion, did the defendant demonstrate the actus reus and mens rea necessary for a crime to have occurred? Defend your response. (Remember to maintain a formal writing style throughout the document. Keep in mind that it is possible to express an opinion in 3rd person. Ex: Based on the established evidence, the defendant does/does not appear to have committed a crime because...)
