Twelve treadmills line the windows in a running-designated area of a popular gym. Nine of the treadmills are modern and work perfectly all the time, while three of them periodically stop for unknown reasons. No runner has ever been injured as a result of any fall on the three treadmills. The gym had posted warnings on the three broken treadmills indicating the nature of the problem, but after realizing the high demand for three treadmills, management removed the warnings and decided to keep the malfunctioning treadmills until they were able to purchase replacements. One day, one of the treadmills stopped abruptly. The runner using the treadmill had been reaching down to retrieve his dropped headphones, and the sudden stop caused him to pitch forward, breaking his outstretched hand. Does the runner have a negligence claim against the gym? (Please go through a full analysis). What damages might the gym be liable for? Additionally, would the runner have a claim against the manufacturer of the treadmills? Explain.
