Respond to this post. In the Supreme Court case, United States v. Windsor, it goes into effect the discrimination some of our citizens feel based on their sex orientation and who they want to love. This takes us to the protection they want under the animus doctrine under the 14th Amendment of the United States Constitution and the violation of their civil rights (Araiza, 2023). The check-in balance in our government system limited the power each branch of the United States has and stopped the abuse of power that is explained in the US constitution (McClory, 2010). This means each branch has limited power, and this was an explicit design to stop any king or president from declaring dictatorship and to have the right of the citizens' voices and needs heard. Within this, we see the case of United States v. Windsor refusing, according to the complaint, to address their civil rights being violated and not having any protection under the constitutional law since they are citizens of the United States. The striking down of DOMA that was passed by the legislature in 1996, was both constitutional but not on it whole making the legislature to be unconstitutional and therefore.
