Discussion 1

Read the article titled, "Does Death Penalty Save Lives? Next, take a stand for or against the death penalty and discuss the effectiveness of the death penalty in preventing murders.

I have and always will be for the death penalty. I believe that the death penalty is the appropriate punishment for those that commit murder on a level that surpasses anything justifiable or accidental. As far as the death penalty preventing murders, I do not see how anybody can come to that conclusion, regardless of how many years of studies they partake in. When somebody has it in their mind to kill somebody, they are not thinking about receiving the death penalty should they get caught, they are going to do what they set out to do regardless. If death sentences were carried out at a much faster rate, say time an individual is sentenced they receive their punishment, then I would agree that it is an effective deterrent method.

Identify and discuss one (1) major difference between State Tort Cases and Federal Section 1983.

One major difference between State Tort Cases and Federal Section 1983 is who is able to be sued under each case. Under State Tort Cases both public officials and private persons can be sued, and under Federal Section 1983, only public officials can be sued. State Tort cases involve the wrong doing of one or more persons, and the laws that are broken are state laws. These laws allow for everybody to be held liable for their actions, regardless of whom they are, and their status within the community.
