QUESTION 1: Mr. and Mrs. Smith are getting divorced after 12 years of marriage. They have two children, ages 10 and 4. There is some evidence that Mr. Smith has been physically abusive to his wife, but not his children. He also admits to "enjoying a few cold beers" after a long day at work. Mrs. Smith is currently a stay at home mom because Mr. Smith earns enough so that she has this opportunity.

Develop a case plan for this family, and whether or not you would involve outside parties in the divorce and why.

QUESTION 2: Explain the specific differences between arbitration and mediation. Give an example of each.

During an arbitration there is a third parties who is the arbitrator. An alterative dispute resolution will take place. Both parties will agree to comply in advance. Both parties will participate in the out of court hearing to present their evdience. The arbitrator decision is normally the final decision.
