Mr. Billy Blues operates a jazz bar in New Boston, FL by the same name ("The Boston Note") and has a Web page on the Internet advertising the bar. The website includes contact information in Florida for tickets and hours of operation.

In MA, the Mr. Joseph Jazzy brought an action against the defendant alleging trademark infringement, dilution, and unfair competition. The defendant, Mr. Billy Blues moved to dismiss for lack of jurisdiction.
