The focus of this exam is to analyse one of the themes below from the perspective of international humanitarian law (IHL). Your paper shall explain and analyse legal challenges to different characteristics (concepts/legal features) associated with your theme, and that relate to modern warfare and new security threats. These challenges are relevant for the understanding of the development of international humanitarian law.
The characteristics you deal with in the paper is up to you, but they need to clearly frame the very essence and nature of international humanitarian law. Hence, consider how and when the legal framework applies, legal persons, basic principles and possible tensions to other legal frameworks or systems. Also think about to reflect upon the creation of international law, state practice and its consequences for the development of law.
The following is the theme for your paper:
- The legality of nuclear weapons
Make use of the seminar discussions, and please note that you must use and refer to literature from module 2. It can also be relevant to use literature from module 1. You need to apply law and refer to relevant articles in conventions, treaties and other sources of law to pass the exam. In addition, you are encouraged to refer to other relevant materials, which you consider necessary, for example academic articles but also cases and legal decisions, reports from the UN, or other international organisations and/or NGOs.
Please note: The list of characteristics you identify for your analysis is not exhaustive. This means that the number of characteristics/concepts you choose to deal with in your paper is not relevant. What is relevant for the overall impression of your paper is how well you are able to demonstrate knowledge of the topic by connecting relevant applicable law to these characteristics and how advanced you are able to analyse the legal challenges to these provisions and standards.
Structure of your paper:
Introduction:
Present your approach to the subject matter and introduce the focus of your paper. Here you clearly identify the characteristics associated with your theme that you choose to deal with, and what challenges that exist in the development of modern warfare and new security threats. Here you can also pose questions that you will answer in your paper.
Discussion/Analysis:
In the discussion/analysis section is where you present the characteristics more in-depth and applicable law and also discuss (critically analyse) the legal challenges connected to the application of law.
Conclusion:
In the conclusion you make a summary of your analysis, present your findings and make reflections on these findings and on the main arguments of your paper.
