Assignment 1: Problem Exercise
Task Description
Part A
Alice is employed as a salesperson. She was calling on Bryce's gift shop to sell him some office stationery when she saw a gold watch on the floor behind a large display unit. Alice picked it up and handed it to Bryce who, on not recognising the watch, takes down Alice's name and address. Some months later, Alice returned to Bryce's shop and sees the watch for sale on the counter. She tells Bryce the watch is hers and she wants it back. He tells her she can't have it and asks her to leave immediately, which she does.
Alice's sister Milly has been staying with Alice since Milly was injured in an accident earlier in the year. Milly's rehabilitation had been progressing well until her ex-boyfriend Leon began a campaign of trying to win her back. She told him the relationship was over and to leave her alone. Leon could not get his attraction to Milly out of his mind and began hanging around outside Alice's house.
After spotting Milly walking down the street on her crutches, Leon began following her and whispering all the inappropriately sexual things he would like to do to her if she began dating him again. Wanting to get away, Milly struck Leon hard in the stomach with her crutch winding him.
Late one night, Leon went to the house and threw a hammer he had in his car through Milly's window. The force of the hammer shattered the window. Woken in such a startling manner, Milly leapt out of bed and in her rush to escape the room to get help, trod on the glass and suffered cuts to her feet.
Alice and Milly have approached your firm for advice. Alice is seeking advice solely on the situation with Bryce; Milly is seeking advice about the incidents involving Leon. You have been asked to provide written advice to your senior partner on the legal issues arising from the above facts with respect to the intentional/trespass torts to person and personal property relevant to each client. In your answer you must identify the legal issues and apply relevant law to the facts and outline the probable outcomes or consequences for the parties involved.
The relevant legal actions and defences to be discussed are confined to those covered in Modules 3-6 of this unit. Likely or appropriate remedies should be briefly mentioned, but should not form a large part of your answer. Do not provide advice on criminal or other legal actions possibly arising from the facts. It is important to avoid going off on tangents unrelated to tort law.
Part B
You are required to complete and submit the self-evaluation form (available on the Assignment 1 link) as part of your assignment. Please submit this form within the same Word document as Part A if you can. Simply cut and paste it onto the first or last page of your assignment.
The self-evaluation form requires you to ‘self-assess' or ‘judge' your answer to Part A against the marking criteria for this task. To complete the form, read each of the criteria listed down the left-hand
side of the form, then allocate yourself a ‘standard' for each by highlighting the relevant font in either yellow, green or bold.
You also need to provide some comments in the ‘Overall/general comments' box that expand on/explain your judgments about your own work.
Think about explaining:
- What do you think you did best in this assessment task?
- What do you think you did least well (or are unsure of) in this assessment task?
Minimum word count is 100 words. There is no upper word limit to this section (but don't write a novel!)
- what I am looking for is simply an honest appraisal of the work that you are submitting based on the criteria for the task. You do not need to make comments in response to all of the listed criteria, but it can be a good idea to use this section to briefly explain why you chose one standard (ie HD/D/C/P) over another for particular criteria.
The main purpose for this task is to develop your ability to make independent judgments about the quality of your own work and to get you to read the marking criteria for Part A.
Length: 1500 words (applies to Part A only). Bibliographic details in footnotes are not included in your word count. Marks are not deducted if over the word limit, but the marker will not read words in excess of 10% of the limit.
