Verna is a cable TV installer who installs cable as an independent contractor for several companies, including Green Cable. Verna's agreement with Green requires that she furnish her own vehicle, pay for her own gas, vehicle maintenance, and insurance. Green pays Verna a flat fee for each installation. The agreement between Green and Verna requires Verna to wear a shirt with the Green Cable logo when installing cable for Green's clients. Green provided Verna with business cards with the Green cable logo to present to customers when she shows up for an installation appointment.
Kevin called Green to have cable installed in his home, and Green sent Verna to his home. While installing the cable, Verna leaned her ladder against a wall in a careless manner. The ladder fell, striking and injuring Kevin was injured. Kevin sued Green, alleging that Verna was an agent of Green.
