In June 2014, two 12-year-old Wisconsin girls, Anissa Weier, and Morgan Geyser, were charged with first degree attempted homicide. A month earlier, they had tried to kill their friend, Payton Leutner, to appease a fictional internet character named "Slender Man." Share your thoughts regarding the Slender Man case.
1. Anissa and Morgan were 12-years-old at the time of the crime. However, they were charged as adults. What do you make of that decision? Under what circumstances, if any, should juveniles be waived up to adult court? (textbook pp. 541-542)
2. The parents of Anissa and Morgan were not present during their interrogations. Do you think the girls understood their rights when speaking to the interrogators? (textbook pp. 536-539)
3. Wisconsin law requires only 10 of 12 jurors to render a verdict on whether a criminal defendant wasn't responsible for her actions due to a mental condition. Both girls took a plea deal on a lesser charge, and the juries found them not criminally responsible for their actions due to mental illness. Do you agree with this verdict? Why or why not?
4. Anissa was sentenced to 25 years in a mental health facility while Morgan was sentenced to the maximum 40 years in a mental health facility. What are your thoughts about this sentencing? Do you -think it was fair and appropriate?
5. What is your reaction to learning that Anissa was released in July 2021, and do you think the conditions of her release (e.g., case management/medication monitoring, no social media, internet use must be monitored, GPS monitoring, no contact with victim) are reasonable? Are there other conditions the Court should consider?
