Assessment 1 - Research Plan
In assessment one (1), you are to complete a research plan that will be used to complete assessment two (2) - Research Report. To help you with your research plan, below is the scenario you will base your research on.
Scenario - You work for the Justice and Attorney- General as a Legal Administration Assistant. Kimberley Cole, Prosecutor, is your immediate supervisor and she had indicated to you that she and subsequently you have been seconded to a project reviewing some high profile criminal matters in Queensland. The matters that you are to review are:
- Brett Peter Cowan (the Daniel Morcombe Killer)
- Gable Tostee (Tinder Playboy)
- Brenden Abbott (Postcard Bandit)
- Gerard Baden-Clay
- Rick Thorburn (killer of schoolgirl Tiahleigh Palmer)
Kimberley has stated that you are to start on one of the above and complete a report analysing the effectiveness of the trial system in high profile crime matters and argue whether they should be heard and determined by a Judge and Jury or a Judge only trial. In your evaluation, you should:
- Evaluate the pros and cons of using Juries in these types of matters
- Evaluate the pros and cons of having a Judge only trial
- Evaluate the impact that media/social media has on such trials and whether Judges and Juries are influenced by media/social media reports and whether the defendant receives a fair trial
In order to complete this task, you are to complete your Assessment Coversheet and follow this with the attached Research Plan Template and submit it to your teacher for approval prior to completing assessment two (2).
There are three questions to answer -
1. Research and provide a written response (250 words) what you believe are the reason/s that such a report would be required by the Department.
2. Briefly evaluate the legislative requirements that you would have to apply to research, access and use legal information for this report.
3. Describe the elements of a report (format) that you will use in your report that you must do from the scenario.
Assessment 2 - Research Report
Assessment Task 1 saw you prepare a Research Plan and you are to refer to this whilst preparing your Report.

In order to complete this task, you are to complete a research report as outlined below. Your 2000 word report should include:
1. Title page containing all relevant details to the scenario
2. Contents page including page numbers
3. Introduction
The Introduction should be a precise summary of why the report was needed (Purpose) and what the report will discuss.
In your introduction, ensure that you have addressed the aims of your research, the limitations that were faced and who authorised the research. Discuss the primary and secondary sources of information that were accessed.
You need to provide enough background information on the report and state the purpose of the report and what the report will cover.
4. Method
This is a summary of what was done and why it was done. Hint - Use past tense as these things have already been done and then it is required that you discuss how it worked out.
5. The Case - Explain the details of the case chosen. Hint - which court, judge/jury, plea, trial etc.
6. Analysis / Discussion
This is a summary of the status or situations that fall within the scope of parts one and two of the research report. Discuss what was discovered and observed when conducting the research for this report. In this section, you will need to discuss findings and analyse the parts of the topic in detail. Hint - do not forget to incorporate the effect (if any) of media on the case you have chosen as example/s of your findings on this part of the report
7. Conclusion
This section sums up the main points of the report. The conclusion should clearly relate to the objectives of the report. In this section there should not be any new information that is presented. This is not the place for it and should be included into findings or analysis section of the report.
8. Recommendations
This section is where recommendations are detailed in relation to our legal system and what the report found that can be done to improve the current status. Clearly stated should be what it is that the report is recommending and how it should be implemented.
9. Reference List & Legislation List
Remember that you need to be providing all sources of information that you have used in your Reference List on the Assessment Coversheet. You may find new sources, however, you should use at least the sources you identified on your plan. Harvard Referencing System is to be used.
Legislation List needs to be completed on the Assessment Coversheet.
10. Appendices
If you want to put in any appendices eg Newspaper reports, articles.
