Carolyn Brazil wrote a check to a contractor who agreed to make certain improvements on her home. She wrote the check in reliance on the contractor's false representation that the mate rials for the job had been purchased, when in fact, they had not. Brazil had the bank on which the check was drawn stop payment on it.

Another bank, which cashed the check and became a holder in due course of the instrument, attempted to recover the amount of the check from Bra zil. Could it do so? Explain.
