Discuss the remedies a party to a construction contract has where the other contracting party commits a breach of contract".

1. Consider the provisions in AS2124-1992 with regard to the dispute resolution processes the principal and or the builder can take. As you know they can decide to also go to arbitration and or litigation.

2. Consider the common law and equitable remedies if the principal or the builder decide eventually to go to litigation. With regard to the equitable remedies you can confine yourself to specific performance and injunctions.

This question is confined to commercial building contracts and does not deal with major domestic building contracts. Word guide around 800 words.

You will need to refer to all the relevant provisions of AS214-1992 and all relevant case and statutory law.
