(a) Discuss the powers and duties of the employer under the Employment Rights Act 2008? (b) Discuss the powers and duties of the worker under the Employment Rights Act 2008?
Perfect Welders Ltd is a leading company in welding and has about 200 employees. Mr Careful made a complaint that he had not been provided with protective eyewear to perform his welding job. Whilst he was on duty, he was involved in a minor accident and was offered first aid. The next day, he persuaded his other colleagues to stop work since proper safety equipment had still not been provided to employees. The work was stopped for two days entailing significant losses to the company as it had failed to meet the deadline for an important contract. Mr Careful was summarily dismissed. He is now suing Perfect Welders Ltd for unjustified dismissal. He has been in their continuous employment for the last twenty years and has been a model employee.
Advise Perfect Welders Ltd.
