The video above discusses the 2011 Supreme Court decision that allows officers to enter a residence, without a warrant, based on the belief that evidence is being destroyed. I have included a link to the actual text of the case.
After watching the video of the discussion of the use of police power to enter a home, make an argument either for the necessary governmental warrantless intrusion into a zone of privacy to protect society or argue against the warrantless entry into a dwelling based on probable cause and the belief that evidence is being destroyed. The Supreme Court in this case ruled in favor of the warrantless entry into the dwelling.
Even if the warrantless entry into the apartment is approved by the Supreme Court, why might it be necessary to obtain a search warrant after entry is made and illegal drugs are discovered in plain view? What changes after the police make entry and secure the scene?
