Third party beneficiaries by definition had no input into the negotiation or creation of a contract, nor do they contribute any consideration to the contract. Yet, in some situations we grant third party beneficiaries standing to enforce a contract. Why would courts allow intended beneficiaries to enforce a contract they had nothing to do with, but refuse to do the same for incidental beneficiaries?
