Lebron James and Steph Curry were approached by Draymond Green who proposed to open a business amongst them called Warriors’ Shoes. The three had decided they would all contribute the same amount of start-up capital to open the first shoe store. They agreed that all three would operate the business together for a few years to test its viability and should it be successful, they would then incorporate the business under the name Warriors’ Shoes & Co. Ltd.

After the first three months of operating the business, Steph Curry was approached by Klay Thompson who thought the business was an excellent idea. He asked to be a part of the business. He loaned Curry $500,000.00 to help buy inventory. Curry accepted the money. Curry never discussed this development with Green or James. Klay approaches you and tells you he is now a partner in Curry’s business venture.

Explain to Klay whether he is a partner or not?
