The President of a company wants to offer a serverance pay incentive to encourage some of his older workers to retire. One of his managers signed the incentive and retired. Another manager asked for the incentive package, but noticed that the release did not advise the employee that she could consult with an attorney before signing the release. Two months after signing the release, the manager files an age discrimination claim with the ADEA. What advice would you give the president and why?
