Dr. Dave has a widely listened to radio show which involves giving advice to individuals who call in about relationships, child rearing, and mental health issues. During an interview with a newspaper, Dr. Dave states that while he does have training in counseling, his doctorate is in human physiology. The interviewer asks if it is ethical for Dr. Dave to use the title "Doctor" since his doctorate is not incounseling or psychology. Dr. Dave answers that he does have a doctorate and therefore he is not doing anything unethical.

What are the ethical issues involved?
In summation, Dr. Dave is a radio personality and speaks about several topics such as relationships, children and health issues on air. He gives the credentials and knowledge as an experienced licensed professional. However, his doctorate is in human physiology. He is a doctor (PhD) within his field and legally but not a clinical doctor. Additionally, he is diagnosing individuals that are calling in the radio station subconsciously.

As it relates to American Psychological Association (APA) standards there are multiple explanations that are questionable. In examining the situation you have to wonder was this malicious intent or an honest mistake. Some of the common reasons why this happens are lack of knowledge or education. Individuals are unaware of the standards or code of practice related to psychology or any other field.


According to APA guidelines there are defined regulations within the scope of practice. It also provides an outline of what best practices, efficacy and ethical behaviors. There are 2 laws that resonate with me in this dilemma. The standard 5 expresses the need and importance of using correct credentials appropriately. Psychologists do not make false, deceptive or fraudulent statements concerning (1) their training, experience or competence; (2) their academic degrees; (3) their credentials; (4) their institutional or association affiliations; (5) their services; (6) the scientific or clinical basis for or results or degree of success of, their services; (7) their fees; or (8) their publications or research findings (American Psychological Association, 2010). "Psychologists claim degrees as credentials for their health services only if those degrees (1) were earned from a regionally accredited educational institution or (2) were the basis for psychology licensed by the state in which they practice"(American Psychological Association, 2010).

Equally important, is the standard 4 regulation on the APA website. This policy explains the requirement of informed consent, HIPPA privacy related to recordings and disclosures. Furthermore, the intent to provide therapeutic information, consultation or treatment should be performed in privacy with the client. It also should be relayed to the client or patient if such information will be used or revealed to other parties outside of them. "Before recording the voices or images of individuals to whom they provide services, psychologists obtain permission from all such persons or their legal representatives" (American Psychological Association, 2010).

To sum up, I would take several steps to clarify and correction the situation. First, I would make an announcement letting individuals know that I was not licensed in counseling professionally. Second, I emphasize that my personal opinions should be taken freely and not a professional context. Lastly, inform individuals of my professional background and possible discontinue this portion of programming.

Situation:

A 23-year-old man, Mr. L, has been in psychotherapy with a psychologist, Dr. T. During the course of treatment, Mr. L has described his anger at his former girlfriend, Ms. S, an undergraduate student at a local university. As therapy has continued, Mr. L's anger with Ms. S has become more intense. During the most recent session, Mr. L stated he was going to kill Ms. S and left the office.

What are the ethical issues involved?

"1.02 Conflicts Between Ethics and Law, Regulations, or Other Governing Legal Authority
If psychologists' ethical responsibilities conflict with law, regulations or other governing legal authority, psychologists clarify the nature of the conflict, make known their commitment to the Ethics Code and take reasonable steps to resolve the conflict consistent with the General Principles and Ethical Standards of the Ethics Code. Under no circumstances may this standard be used to justify or defend violating human rights (APA, 2010)."

This particular case study is clearly an example of there being a conflict between privacy or client and psychologist confidentiality. Although the psychologist has sworn to uphold confidentiality, some cases allow disclosure without client consent, "In some specific situations, psychologists can share information without the client's written consent. Common exceptions are: Psychologists may disclose private information without consent in order to protect the patient or the public from serious harm - if, for example, a client discusses plans to attempt suicide or harm another person (APA, 2010)."

This case is an extreme example and the psychologist must respond appropriately because his client has threatened the safety of someone else and the possibility of him acting upon what he has stated is highly likely, although in this instance I would go as far as to state the psychologist has no room for error or to further contemplate what should be done, the law is clear in this regard.

If I were in this situation, I would first try to de-escalate my client in a non-threatening manner, if I were unsuccessful and the client walked out of my office in distress, I would immediately alert the authorities of my client's statement and possible plans. If my attempt at de-escalation was successful, I would still alert the authorities of what my client said in session to do as much to prevent any unnecessary harm from being done to anyone.
