Mr. McDowell was a franchisee in the company McDonalds. Claire visited Mr. McDowell’s McDonalds and accidently was burned by some very hot coffee. The parent company and franchisor McDonalds provided explicit training and adequate warnings on the label that their coffee was extremely hot and could cause serious burns or injury. The franchisor also mandated the franchisee to remain open twenty-four hours and hire Blake as their cashier. Mr. McDowell was pleased with being open late and the new hire.  

Claire sued the franchisee and franchisor McDonalds for her injuries. Please only explain whether Claire can sue both the franchisee and/or franchisor and articulate why.
