A nursing career is perhaps the most challenging, yet rewarding career that exists today. It is also one of the most difficult professions, as it is in demand in the healthcare field. Some current issues that nurses face would be the shortage of staff that is growing in organizations. (Top Issues for Staff Nurses, 2016). This can cause stress to nurses since they may have to see more patients, and treat them at the same time. Some legal issues that can be associated with this would be the concern of negligence. “The essence of a negligence claim is that one’s conduct fell below the expected care and the failure resulted in injury”. (Dearmon, n.d., p.472). The risk of negligence can increase when there are more patients that have to be treated, while having only a few nurses. Besides the concern of patient safety and quality of care, the nursing field is expanding their leadership role in healthcare. Some nurses may pursue a management or an executive career. This would mean that they would have to face corporate law, and may be held liable for any incidence that occurs in the management environment. An example of a leadership role in nursing that is exposed to legal risks is the hiring process. A manager who is looking for a nurse practitioner would have to make sure that the individual is licensed, and has all their licensing up to date. This process is known as credentialing. It can be defined as “… The process of obtaining, verifying, and assessing the qualifications of a practitioner to provide care or services in or for a healthcare organization.” (The Who, What, When, and Where's of Credentialing and Privileging, n.d.). If not, the organization may face credentialing liability.
