Case Assignment

(Signature Assignment: Information Literacy, Reinforced Level)

In this Case 1 you will be finding, selecting, and incorporating the most effective sources of information to support your discussion of Plump n' Stuffy's actions as they relate to discrimination laws and regulations. Give special attention to
the quality of sources utilized.

Exploring Equal Employment Opportunity and Discrimination

Before starting this assignment, be sure that you are familiar with the following: Title VII of the Civil Rights Act of 1964 (Click on the link for a brief overview.) Age Discrimination in Employment Act (Click on the link for a brief overview.) Terms: Disparate/adverse impact; disparate/adverse treatment

U.S. Supreme Court Case: Griggs vs. Duke Power Company Begin this assignment by reading the following scenario:

Plump n' Stuffy Stuffed Pepper Company, a major processor of fresh and frozen stuffed peppers sold throughout the United States, employs 202 workers at its principal processing plant. The plant has a relatively young crew with 74% of the workforce between the ages of 22 and 30. The plant is in Jackson, Mississippi. Plump n' Stuffy requires a high school diploma or GED as a condition of employment for its cleaning crew. Right now, Plump n' Stuffy's entire cleaning crew is Caucasian.

1. How is information about Jackson's labor market important in considering whether or not Plump n' Stuffy is in compliance with the Civil Rights Act of 1964? Discuss the relevant data you have found associated with Jackson's demographics.

2. In your educated opinion, does Plump n' Stuffy need to make policy changes to ensure compliance with Title VII of the Civil Rights Act of 1964? Should there be changes to comply with the Age Discrimination in Employment Act? If so, what changes should Plump n' Stuffy make, and why are they necessary to comply with each of these important laws?

3. Use at least 6 sources, at least 4 of which should be found on your own (outside of the module readings). Provide a 1 or 2page Appendix discussing why your nonmodule sources (ones found on your own) were chosen and what criteria you used to determine that they were appropriate sources to utilize for your academic paper.

Assignment Expectations

Your paper will be evaluated using the criteria as stated in the Case rubric. The following is a review of the rubric criteria:

AssignmentDriven: Does the paper fully address all aspects of the assignment? Is the assignment addressed accurately and precisely using sound logic? Does the paper meet minimum length requirements?

Does the paper address the topic with sufficient depth of discussion and analysis?

Business Writing: Is the essay logical, well organized, and well written? Are the grammar, spelling, and vocabulary appropriate for graduatelevel work? Are section headings included? Are paraphrasing and synthesis of concepts the primary means of responding, or is justification/support instead conveyed through excessive use of direct quotations?

If required, has the student demonstrated effective research, as evidenced by student's use of relevant and quality (library?) sources? Citing Sources: Does the student demonstrate understanding of APA Style of referencing by inclusion of proper citations (for paraphrased text and direct quotations) as appropriate? Have all sources (e.g., references used from the Background page, the assignment readings, and outside research) been included, and are these properly cited? Have all sources cited in the paper been included on the References page?

Timeliness: Has the assignment been submitted to TLC (Trident's learning management system) on or before the module's due date?

Case Assignment

You are an HR Manager for a large plastics company. One of your largest customers has just secured a major office furniture contract with the federal government. Your customer wants your company to become a subcontractor for the project, making all of the plastic parts required. There is uncertainty among your organization's top officials about whether or not to become part of this project, even though it would be very lucrative. The disagreement centers around the preparation of an affirmative action plan and the goal achievement requirements imposed to correct underutilization.

Discuss additional EEO compliance requirements that impact a federal subcontractor. Also, be sure to discuss the important components of an affirmative action plan (expanding on the goalsetting process), and discuss how affirmative action goals should relate to an organization's strategic human resources plan.

Use at least 5 library sources to help strengthen your discussion.

Please upload your paper by the module due date.

The paper should be at least 45 pages, not counting the cover and reference pages.

Using additional research about unionization in the U.S. airline industry in general and American Airlines in particular, update where we are currently with American's situation. How do the recent updates that you have found affect American Airlines employees? Are other U.S. airlines also in jeopardy because of labor demands?

Tailor your discussion as much as possible to recruiting these targeted applicants to the large equipment industry.

Draw on your own research to identify (by name) reallife, privatesector employers who have used some of the recruitment techniques that you propose. Discuss their reallife experiences as examples in your news release.

Integrate your responses to the following as you prepare your paper:

One of your old college roommates who now lives in New York City just called you. He said he was on vacation this week attending a crossdressing convention and got a call from his boss. His boss told him he just lost his job in a layoff along with 50 other employees in the same privatesector company (that had 850 employees pre layoff). His boss told him he was being laid off effective immediately because he refused to take a lie detector test concerning drugs found in his company locker. He also refused to take a drug test because he was afraid that a false positive would result in the state child protection agency taking away custody of his children.

Read the following scenario:

Jack and Eric are both hourly employees in the finishing department. They work under Phil, the first shift finishing foreman. Steve is the second shift foreman.

Jack has been complaining that Eric is trying to get him to quit so that Eric's friend can be employed in Jack's job. He says Eric has bullied and harassed him. Jack thinks it is because he (Jack) helped in union organizing activities last year (Eric is antiunion).

Jack says that Eric complains about anything that Jack does and constantly badgers him to quit. Jack alleges that Eric deliberately does not share crucial information about daytoday work, which then creates the impression that Jack is underperforming in his role.

Jack has raised concerns about this treatment from Eric on many occasions with Phil, his foreman, who has simply told him to deal with the matter himself.

Jack says he is stressed out and alleges that things came to a head when Eric spent a whole day picking on him and he (Jack) openly wept. Eric repeatedly told Jack that he was not wanted on the finishing team and should quit.

Jack couldn't afford to be without a job and did not see why he should be forced out. He went home and decided that he was too upset to go to work the following day.

He called in that night and told the next shift's foreman, Steve, that he was too stressed to go to work the next day because he would be picked on.

Steve said he was aware of what had been alleged and thought it had been dealt with by Phil months ago. He advised Jack that he should not go to work the next day and that he (Steve) would speak to Phil.

Jack did as he was instructed, and missed the next day of work. When he returned the following day, Phil called him into the office to ask why he had not been at work and why he had not called in to speak to him directly to report his absence.

Jack was told that because he did not comply with the callin policy he would get a "ding" on his attendance record. He explained that he called and talked to Steve who was aware of what had happened and had advised him not to go into work the next day.

Phil laughed and told Jack that the department had had bets on whether he would be at work the day after he had been crying and that because of his failure to attend, Phil and Steve had each won $50.

Jack told Phil that he was going to file a grievance with the union because he thought the way he was being treated was not right.

Phil told Jack that if he filed a grievance he would be fired for insubordination. Instead, he should just knuckle down and do his work.

Phil thinks that Jack is the problem, not anyone else.

Jack is very upset and decides that enough is enough. He files a formal grievance with the union about this situation.

Question:

What do you think will happen next? Why? Discuss the important steps that might take place to resolve this issue. If you were the HR manager in this plant, what would you do to get to the root of the issue? Why?

Use at least 2 Trident Online Library sources plus any applicable background readings to help strengthen your discussion.

The paper should be 23 pages, not counting cover and reference pages.
