The 5th Amendment to the U.S. Constitution allows the government to take private land for public use without "just" compensation to the landowner. However, the landowner is afforded the opportunity of notice of such an action and an opportunity to be heard in a court of law. Simply put, eminent domain is the government's right to take a person's real property from private landowner for reasons such as creating new jobs, generating higher tax revenues, to build roads, highways and for transportation related projects and the like, and for the protection of people's health, safety, and welfare, as in the case of emergencies; and economic development overall.
