Frank, a farmer for over thirty years was visited by Ollie, a buyer for Stop N Shop. Ollie offered to purchase Frank's entire "Georgia" peach crop (200,000 peaches) at 50 cents each with delivery by Frank in six months. Frank agreed and they shook hands. A few days later, Frank was visited by Paul, a buyer for Shop Rite Stores. Paul indicated he was prepared to purchase Frank's entire "Georgia Peach" crop at 60 cents per peach with delivery in six months and he prepared a written purchase order which frank signed. One week later, Frank received in the mail a letter from Ollie, which included a purchase order summarizing their oral agreement. Frank threw the letter and purchase order in the garbage. Six months later, Ollie contacted Frank and demanded to know when Stop N Shop was going to receive the peaches. Frank said contract? I never signed anything!! "One week later, Stop N Shop placed an order with Fancy Farms for 200,000 Deluxe Georgia Peaches at $1 each, although other "Georgia" peaches could be had for 75 cents or 80 cents each. Discuss the issues and rights of Paul, Frank and Ollie. Contract(s)? Breach? Concepts? Damages?
