Landis Lubber, a resident of Indiana, inherited 15 acres of land in New Jersey from her Aunt Snookie. She decided to sell the property to Jersey Shore, Inc. for the sum of $1,000,000. Jersey Shore, Inc, entered into a contract with Landis Lubber for the purchase of the above property on March 1, 2007. On September 2, 2007, the New Jersey Environmental Board designated a large area of land as preserved wetlands, barring commercial develoment of any type for a 5 yr period. The re-zoning would become effective April 1, 2008. The preserved wetlands included the property sold by Landis Lubber to Jersey Shore, Inc, On September 15, 2007, Jersey Shore Inc., upon learning of the board's decision, sent a letter to Landis Lubber, stating that it intended to stop making its monthly payments for the land after April 1, 2008 due to the board's decision to re-zone the land as preserved wetlands.
