He signed it because he needed the money. There was a mandatory arbitration clause along with a requirement that any claim must be filed within 30 days of the event if a claim was found to be nonarbitrable, the losing party was to bear the costs, and punitive damages were excluded. After he was fired, Alexander sued the company for age and race discrimination. Was the agreement unconscionable and therefore unenforceable? Why?
